Terms of Sale & Refunds

How buying a licence works — who the seller is, prices and taxes, delivery, your right of withdrawal and our 14-day refund promise.

In short. Licences are sold by our reseller, Creem, which handles payment, VAT and invoices. You receive your key right away. If the app isn't right for you, ask within 14 days of purchase and you get your money back — no reasons needed.

1. Who sells the licence

When you buy a licence for one of our apps on our websites, the seller of record ("merchant of record") is our authorised reseller:

Creem sells you the licence in its own name, processes the payment, charges and pays VAT or sales tax, issues your receipt or invoice and handles payment disputes. Its own terms and privacy policy apply to the checkout and are shown there. We — [Person 1: full name] (VAT no. [Person 1: VAT number]) and [Person 2: full name] (VAT no. [Person 2: VAT number]), who publish under the Moka Solutions brand — are the publishers and licensors of the app: we issue the licence key, grant the licence under our EULA, provide updates and support, and are responsible towards you for the app's conformity.

If we ever add or change a reseller, we will name it here and at checkout. If you get one of our apps from an app store (for example Apple's App Store), that store is the seller, and its terms, prices and refund procedures apply to the purchase; the EULA still applies to the app.

2. What you buy

You buy a licence to use an app as described in its product terms (for example Espresso): the edition, the number of devices, and which updates are included. Unless the product terms say otherwise, a licence is a one-time purchase, not a subscription: you pay once and are never charged again.

Before you pay, the checkout shows the product, the price, the taxes and the main features. Please check the system requirements, and try the free edition or trial first where there is one.

3. Prices and taxes

Prices are shown at checkout in the currency offered there. For consumers, prices include VAT or the equivalent tax of the buyer's country, calculated by Creem. Business customers in the EU who enter a valid VAT number are invoiced by Creem according to the applicable rules (for example reverse charge).

When we announce a price reduction, we also show the lowest price applied in the 30 days before it, as required by art. 17-bis of the Italian Consumer Code (EU Omnibus Directive). An introductory price is always shown with its end date.

4. Payment

You pay through Creem with the payment methods it offers. We never see or store your full card or payment details.

5. Delivery

Delivery is immediate: after payment you see your licence key on screen (with a link that activates the app directly) and receive it by email. If it doesn't arrive, check your spam folder or write to us: we will resend it. Your key remains available in your Creem customer page, which you can open from the app or from the purchase email.

6. Your right of withdrawal (EU consumers)

As a consumer in the EU, you normally have 14 days to withdraw from a contract concluded online, without giving any reason (art. 52 of the Italian Consumer Code).

For digital content supplied immediately — such as a licence key — the law allows this right to end once delivery has started, if you expressly asked for immediate delivery and acknowledged that you would lose the right of withdrawal (art. 59(1)(o) of the Italian Consumer Code). Creem's checkout may ask you for that consent, and confirms the purchase on a durable medium (email).

Whatever you agreed at checkout, our 14-day refund promise below gives you the same result: you can get a full refund within 14 days of purchase. To exercise the statutory right, where it applies, you can use the model withdrawal form or simply send us a clear statement by email.

7. Our 14-day refund promise

If you are not happy with a licence, for any reason, ask within 14 days of the purchase date and you get a full refund. This applies to everyone — consumers and businesses — worldwide.

How to ask: write to support@mokasolutions.dev from the email address you used to buy, or include your order number or licence key. You can also contact Creem's support directly. We don't ask for reasons (though we are grateful to hear them).

The refund is issued by Creem to the original payment method, normally within 14 days of your request, without any fee. Once refunded, the licence is deactivated on all devices; the app returns to its free edition or trial status, and your data on your devices is kept.

After 14 days, we may still refund in special cases — for example if a problem we cannot fix prevents you from using the app — and your statutory rights (below) always remain.

The app must be as described and fit for its normal use. If it isn't, consumers have the legal guarantee of conformity for digital content (articles 135-octies to 135-vicies ter of the Italian Consumer Code): you may ask us to bring it into conformity, and if that is not possible within a reasonable time, you are entitled to a price reduction or to terminate the contract and get a refund. Write to support@mokasolutions.dev; we are responsible for this guarantee together with the seller of record.

9. Chargebacks and abuse

If you have a problem, please write to us before disputing a payment with your bank: a refund is quicker for everyone. A charged-back or disputed payment deactivates the licence while the dispute is open. We may refuse repeated refund requests that look like an attempt to use the app for free (for example, buying and refunding over and over), without affecting statutory rights.

10. Business customers and volume licences

Organisations need one licence per person using the app (see the EULA). For volume licences, quotes, or payment by bank transfer, write to hello@mokasolutions.dev. Written agreements with business customers prevail over these terms where they differ.

11. Complaints, law and courts

Complaints go to support@mokasolutions.dev; we reply within 14 days at most. These terms are governed by Italian law and the courts are determined as described in section 17 of the Terms of Service, always without prejudice to the mandatory protection of the country where a consumer lives. Creem's own terms govern the payment process itself.
